Earlier this week, CNN obtained a copy of a legal memorandum prepared for then-President Donald Trump that envisioned a “January 6 scenario” under which Trump could seek to overturn the results of the 2020 presidential election, which he lost to Joe Biden.
Authored by conservative law professor John Eastman, the “Eastman Memo,” as it has been dubbed in the press, argued that Vice President Mike Pence, while presiding over the joint session of Congress on January 6, 2021, possessed the sole power to count electoral votes and that Pence should use this power to reject pro-Biden votes and thus deliver the White House to Trump. “Howls, of course, from the Democrats,” Eastman wrote. “The main thing here is that Pence should do this without asking for permission—either from a vote of the joint session or from the Court.” According to Eastman, “the Constitution assigns this power to the Vice President as the final arbiter. We should take all of our actions with that in mind.”
In reality, the Constitution assigns no such power to the vice president. Eastman’s scheme is bogus on its face. Indeed, just imagine if Vice President Al Gore had attempted a similar power grab in January 2001 by unilaterally gaveling himself in as the winner of the 2000 presidential election instead of his opponent, George W. Bush. As Case Western Reserve University law professor Jonathan Alder has observed, the Eastman memo is “poor lawyering for a disreputable cause.”
Alas, those negatives did not deter Trump, who embraced Eastman’s poor lawyering and publicly lobbied his vice president to overturn the election by rejecting pro-Biden electoral votes. “If Mike Pence does the right thing,” Trump said. “We win the election.”
In the end, Pence did do the right thing. “It is my considered judgment,” the vice president said, “that my oath to support and defend the Constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.”

WASHINGTON (Reuters) – U.S. Vice President Kamala Harris said on Thursday that she welcomes India’s announcement that it will resume COVID-19 vaccine exports.
India announced this week that it resume exports of COVID-19 vaccines later this year. India, the world’s biggest maker of vaccines, stopped exports of COVID shots in April to focus on inoculating its own population as infections exploded.

The Taliban is settling in as the new rulers in Afghanistan and some changes are being made. Women are subjected to home detention, advised to stay at home, and only go out if escorted by a male relative. School has opened for boys but not for girls. Does this sound like a new and improved version of the Taliban?
It sounds like Afghanistan is back to the bad old days for most Afghans, especially women and girls. Islamic extremists are back in charge. The Women’s Affairs Ministry is gone, replaced by a new department devoted to the promotion of virtue and preventing vice.
In Kabul, a new sign was up outside the women’s affairs ministry, announcing it was now the “Ministry for Preaching and Guidance and the Propagation of Virtue and the Prevention of Vice.”
Staff of the World Bank’s $100 million Women’s Economic Empowerment and Rural Development Program, which was run out of the Women’s Affairs Ministry, were escorted off the grounds, said program member Sharif Akhtar, who was among those being removed.
The Biden administration’s State Department and White House press secretary keep saying that the Taliban want to be players on the world stage and will act accordingly. The naivety of that idea is off the charts. The Taliban don’t care about the world stage. They intend to return to the days of living in a 7th-century country and that includes Sharia law. Westernization will not be nurtured and the fledgling freedoms women and girls experienced during the last 20 years are disappearing. The Taliban will brutally enforce their will.
News agencies are promoting Taliban propaganda. Just look at this tweet from Reuters that implies all is well – men, women, and children are enjoying time at an amusement park. The problem with the video that accompanies the tweet is that that the presence of maybe one woman is detected, the rest are all men and children. There is nothing ‘normal’ about that scene in the western world.

The hardliners are making inroads in locking down women and girls. Boys are asked to return to school but not girls. Girls have to wait for classes that gender-segregate, which likely means separate schools. Who knows when that will be available?
Mabouba Suraj, who heads the Afghan Women’s Network, said she was astounded by the flurry of orders released by the Taliban-run government restricting women and girls.
On Friday, the Taliban-run education ministry asked boys from grades six to 12 back to school, starting on Saturday, along with their male teachers. There was no mention of girls in those grades returning to school. Previously, the Taliban’s minister of higher education minister, had said girls would be given equal access to education, albeit in gender-segregated settings.
“It is becoming really, really troublesome. … Is this the stage where the girls are going to be forgotten?” Suraj said. “I know they don’t believe in giving explanations, but explanations are very important.”
Suraj speculated that the contradictory statements perhaps reflect divisions within the Taliban as they seek to consolidate their power, with the more pragmatic within the movement losing out to hard-liners among them, at least for now.
The Taliban are gaslighting Westerners by publicly stating that women will be free to be in the open, in public spaces, and will be protected as other minorities are. Yet, the leaders give contradictory orders to the enforcers, the rank and file on the round. UNESCO’s Director-General Audrey Azoulay voiced concern over the decision to deny girls education in classrooms.
“Should this ban be maintained, it would constitute an important violation of the fundamental right to education for girls and women,” Azoulay said in a statement upon her arrival in New York for the opening of the U.N. General Assembly.
That’s all well and good but the Taliban don’t care about violating the fundamental rights of anyone, especially women and girls. It’s what they do. It shows gullibility to believe otherwise. History will repeat itself in Afghanistan. There are no leadership roles in the new Taliban cabinet. It is a radicalized version of Islam that denies education for girls.
Islam does not forbid girls’ education.
No Islamic country in the world has banned girls’ education.

The United States has paid a lot of money to encourage opportunities for women in Afghanistan over the last 20 years. Girls born just before and since America’s presence in the country do not know life under the radicalized Islamic rule of the Taliban. Women expect the worst to come now.
In the nearly two decades since the U.S. invasion toppled the Taliban, the United States has invested more than $780 million to encourage women’s rights. Girls and women have joined the military and police forces, held political office, competed in the Olympics and scaled the heights of engineering on robotics teams — opportunities that once seemed unimaginable under the Taliban.
The question now is whether the Taliban’s interpretation of Islamic law will be as draconian as when the group last held power.
There are already scattered signs that, at least in some areas, the Taliban have begun to reimpose the old order.
In Herat, in western Afghanistan, Taliban gunmen guarded the university’s gates and prevented female students and instructors from entering the campus on Tuesday, witnesses said.
In the southern city of Kandahar, women’s health care clinics were shut down, a resident said. In some districts, girls’ schools have been closed since the Taliban seized control of them in November.
Women there said they were starting to wear the head-to-toe burqa in the street, partly in fear and partly in anticipation of restrictions ordered by the Taliban.
Maybe schools will be set up in private homes for girls, as happened in the previous years of rule by the Taliban. Medical care will likely be segregated by sex again, too.
A few small groups of women have protested the move backward but it likely will not be allowed to continue for long.

In Afghanistan, the Taliban’s Ministry of Propagation of Virtue and Prevention of Vice (MPVPV), which was banned after the US invasion, has reappeared in the wake of Biden’s disastrous withdrawal from the war-torn country.

The infamous ministry was charged with implementing the Islamist extremist group’s strict interpretation of Sharia law, which included a prohibition on women leaving their homes without a male companion and a ban on music and other forms of entertainment, as reported by The New York Post.
Mohammad Yousuf, who says he is around 32 years old and responsible for the “central zone” of Afghanistan, explained the MPVPV and its purpose to The Post:
The main purpose is to serve Islam. Therefore, it is compulsory to have [a] Ministry of Vice and Virtue. We will punish as per the Islamic rules. Whatever Islam guides us, we will punish accordingly.
Yousuf said “actions will be taken” on the “major sins of Islam,” such as sexual intercourse outside marriage, killing someone, and theft. Taliban-style, of course.
Islam has its rules for major sins. For example, killing someone has different rules. If you do it intentionally, if you know the person and intentionally kill the person, you will be killed back. If not intentional, then there might be another punishment like paying a certain amount of money.
If there is a theft, the hand will be cut off.
If there is illegal intercourse, they (violators) will be stoned.
“We just want a peaceful country with Islamic rules and regulations, Yousuf added. “Peace and Islamic rulings are the only wishes we have.”

As The Post noted, in pre-war Afghanistan, MPVPV “moral police” were established on “every street” to inflict harsh punishments on violators including whipping, amputations, and public executions. Now, signs of such incidents have begun to reappear on the streets of Kabul.
Joe Biden, Antony Blinken, Lloyd Austin, and Mark Milley were unavailable for comment.
In related news, as my colleague Brandon Morse noted in a recent article, Western sentiments related to justice, morality, and honor are laughed at by Islamist extremists, who are “only bent on doing two things; subjugation and murder” — while the Biden administration naively continues to whine about seeing “more of the same” from the Taliban, after the brutal terrorist organization promised to “behave.”

On this episode of The Federalist Radio Hour, Neil Patel, Co-Founder and Publisher at The Daily Caller, joins Senior Editor Chris Bedford to recount how he responded to 9/11 as the then-chief policy adviser to Vice President Dick Cheney.
“I have it on my calendar every year the time that the first plane hit the World Trade Center and every year I stop and I just think about it, because it was such a, just a momentous event in our country’s history and because all those innocent Americans who went to war, they had no idea,” Patel said.
“It was like this furthest thing from anyone’s mind that this country in the heart of New York City, the heart of Washington D.C., and even more in a place like Shanksville, Pennsylvania, you don’t wake up as an American expecting … 9/11 was just so out of the blue,” he continued. “So I do have that calendar reminder every year. I think about it every year. I just stop and I think about it. It makes me sad every year.”
The events on 9/11 were tragic, but Patel said the patriotism that followed was inspiring.
“We’re so divided today, and I’m not saying things were perfect then at all but it brought the country together for a moment at least and just this surge of patriotism,” Patel said. “so when I look back on it, that’s kind of what I remember the most.”
Former Democratic Rep. Lee Hamilton, former vice chairman of the 9/11 commission, said the U.S. government has a “ways to go” on the sharing of intelligence information between agencies and within specific departments to prevent attacks against the homeland.
Hamilton also told Just the News that better intelligence sharing could have prevented the September 11, 2001 attacks.
One of the key findings of the 9/11 Commission found a breakdown in the sharing of information between agencies such as the CIA and the FBI. The CIA reportedly knew that two of the future hijackers had obtained U.S. visas but did not formally relay the information to the FBI.
Hamilton said the U.S. government has “made progress” on intelligence sharing since 9/11 but it’s still at the top of his list of 9/11 Commission Report recommendations that he argued still have not been fully implemented.
“Government tends to become very polarized and becomes very jealous of jurisdictions in sharing information and working across not just departmental lines … but also within the same department,” Hamilton said. “There is a great tendency in the federal bureaucracy to say, ‘Let me handle it, trust me, I can do it.’ I’m always wary of that.
“I think you need to make sure that your institutions, your groups, your people are sharing information. If we had shared information that we had before 9/11, there’s not much doubt in my mind but that we could have prevented it. We just didn’t do it. So we’ve put a lot of mechanisms into place that I think are helpful, but we’ve got a ways to go.”
Hamilton said the U.S. is safer overall than we were prior to 9/11.
“Look, we’ve put into place a whole department of government,” said the longtime Indiana lawmaker. “And we have made hundreds of changes in almost every government agency and department, staffing up with real experts, and clearly a lot more money, resources, time, in the whole effort of trying to make sure that government fulfills its function of keeping the vehicle safe. So I think a lot of progress has been made. Now, having said that, a lot more needs to be done. And so the work is still ahead of us.”
Wisconsin Republican Rep. Tom Tiffany told Just the News that the Biden Administration’s handling of the Afghanistan withdrawal as well as the southern border are of “great concern” when it comes to the safety of the nation.
Tiffany was asked if he thinks the U.S. is safer on the 20th anniversary of 9/11 than before before 9/11 or more vulnerable.
“I hope we’re safer, but hope is never an answer to national security,” he said. “And that’s what causes me such great concern is being an optimist by nature, I hope that we’re in a better spot. But, boy, the actions of the last few weeks of the Biden administration and seeing what they’ve been doing on our southern border, where they’re not vetting people down there, we know they’re not vetting people coming into the country.
“Right now, with the evacuation in Afghanistan, it does not give me much solace, that, I just don’t think people can be sanguine about this issue because all it takes is one really bad actor, and you have a disaster in the United States.”
Homeland Security Secretary Alejandro Mayorkas said on Thursday that terrorists affiliated with ISIS would not slip through the cracks as the U.S. vets refugees from Afghanistan.
“We have no information to suggest that ISIS has come to the United States through the Afghan national population that we’ve admitted under our legal authorities,” he said. “And we have a multilayer, multiagency screening and vetting process to make sure that doesn’t happen. We screen and vet individuals before they board planes to travel to the United States and that screening and vetting process is an ongoing one and multilayered.”
Tiffany shared his reaction to a report that an Afghan refugee had explosive materials in his possession. He described the report as “deeply” worrisome.
“Some people are waving aside that person bringing blasting caps and detonator wire on a plane,” he said, “and they’re like, ‘You know, that’s kind of normal practice.’ How many people do that? I mean, that should absolutely set off alarm bells of the vetting process that we’re doing. But it really proves that the vetting process is not working.”

It’s no secret that the past few weeks have not been President Joe Biden’s best. But what about the costar of the “Biden-Harris administration?”
The vice president has been conspicuously absent lately from coverage and appearances pertaining to the botched withdrawal from Afghanistan — after having proudly claimed just four months ago to have been the “last person in the room” with Biden as he decided to fully withdraw U.S. forces from Afghanistan.
Kamala Harris’ absence is especially puzzling given the recent drop-off of confidence in the president. The generally even-keeled Mike Pence was often trotted out to take questions as head of the coronavirus task force, especially after days of the more combative commander-in-chief duking it out with the press corps. The same, however, cannot be said of this vice president.
Speculation that the VP has been benched due to her performance in recent months is beginning to bubble up. “They had a minority, they had a woman, and now that they don’t need her, they have her shelved,” said Fox News’ Will Cain.
Harris’ approval numbers appear to be plummeting even faster than Biden’s, which are now underwater. Harris, however, according to the Real Clear Politics average, is now looking at a favorability rating of just 41.8%, with an unfavorability rating of 48.8%.

On Thursday, RINO sellout Liz Cheney was appointed to leadership within the sham Jan. 6th select committee. The unhinged congresswoman will now serve as the vice chair of Pelosi’s partisan clown show.
The committee chairman – Mississippi Rep. Bennie Thompson – picked Cheney for the position because she has been so committed to “doing whatever it takes” to railroad Trump supporters and dissenters throughout the bogus investigation.
It also doesn’t hurt that she still masquerades as a Republican, which allows the deep state and the bootlicking media to falsely claim that their witch-hunt for political dissenters is “bi-partisan.”
As Michael Knowles would say: “She is a court jester Conservative in the kingdom of liberalism.”
According to Thompson:
“[Cheney’s] demonstrated again and again her commitment to getting answers about January 6th, ensuring accountability, and doing whatever it takes to protect democracy for the American people.
Her leadership and insights have shaped the early work of the Select Committee and this appointment underscores the bipartisan nature of this effort,”
Cheney happily accepted the role, and vowed to “not rest until our task is complete.”
“I have accepted the position of Vice Chair of the committee to assure that we achieve that goal. We owe it to the American people to investigate everything that led up to, and transpired on, January 6th. We will not be deterred by threats or attempted obstruction and we will not rest until our task is complete.”
Cheney knows that her shot at reelection – by way of people voting for her – is all but gone at this point. She recognizes that her only way back into office is to cozy up with the America-hating Dems and hope they include her in the next mail-in ballot scheme.
These sellouts don’t care about the American people who elected them or the constitution they swore an oath to protect. Hundreds of citizens have been unconstitutionally held in Nancy’s DC gulags since the events on Jan. 6th because of their views.
Unfortunately for those who are caught up in this political persecution, there could be no end in sight.
A deadline or timetable for the “investigation” to be completed has not been released, meaning the committee could keep Jan. 6 in the headlines well into the 2022 election cycle, or beyond.
