Ben Shapiro: Daily Wire ‘staffing up’ to ‘defy’ Biden’s ‘tyrannical’ vax mandate in court

(LifeSiteNews) — Conservative media outlet The Daily Wire has no intention of complying with the Biden administration’s impending mandate that businesses with more than 100 employees require them to take the COVID-19 vaccines, with conservative pundit Ben Shapiro confirming that the organization is “staffing up” to fight the “tyrannical and authoritarian order” in court.

On September 9, President Joe Biden announced that he was directing the U.S. Department of Labor’s (DOL’s) Occupational Safety and Health Administration (OSHA) to draft a rule that will, according to the White House, “require all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work.” 

Biden also announced new vaccination rules for federal employees and government contractors, but the bulk of the controversy focused on the administration’s intrusion into the decisions of private-sector employers and employees, which is expected to affect more than 80 million Americans.

The Daily Wire, which Shapiro co-founded with Jeremy Boreing in 2015, promptly responded to the news with an announcement that it “does have more than 100 employees,” but will “use every tool at our disposal including legal action to resist.”

The next day, Shapiro appeared on Fox & Friends to elaborate on the company’s position.

“We’re going to use every method and resource at our disposal to defy the president’s unconstitutional order,” Shapiro reiterated. “And this is coming from somebody who’s very pro-vaccine. I was vaccinated as soon as possible; I’ve encouraged everybody to get the vaccine, or pretty much everybody to get the vaccine.”

However, he continued, “the notion that the federal government has the ability to force every business in America with over 100 employees — by the way, I’m not sure why it’s over 100 employees, theoretically, it should be every business in America because you can get infected anywhere — every business in America with over 100 employees to either force its employees to vaccinate or force them to test every week or fire them presumably.”

“We are staffing up right now on the legal side,” Shapiro went on. “We are already getting any lawsuit ready that needs to be gotten ready. We have to see the actual regulations, know the details of that lawsuit. What we can tell you is that the provisions that Joe Biden is going to be citing under OSHA are wildly overbroad.”

Calling Biden a “failed president on every level,” Shapiro suggested the 78-year-old Democrat was “attempting to redirect all of the ire at his presidency at your fellow Americans,” particularly the unvaccinated, and that the mandate was another indicator that Biden had failed in his early promise that “I’m not going to shut down the economy; I’m not going to shut down the country; I’m going to shut down the virus.” 

Shapiro further predicted that this mandate may have the unintended effect of provoking the U.S. Supreme Court into a “complete rewriting of the administrative state because Joe Biden couldn’t get his act in order, and so he decided to issue a tyrannical and authoritarian order here.” 

The Biden administration’s promotion of COVID-19 vaccination has grown steadily more aggressive, previously announcing it intended to send representatives door to door to urge Americans to do so. At the same time, critics say the White House has undermined vaccine confidence with its refusal to disclose how many of its own staffers contracted COVID-19 after vaccination, as well as the president’s recent false claim that “you’re not going to get COVID if you have these vaccinations.”

Many Americans remain concerned that the vaccines have not been sufficiently studied for negative effects given their accelerated clinical trials.

Vaccine defenders note that the one-year development period was not starting from scratch, but rather relied on years of prior research into mRNA technology; and that one of the innovations of the Trump administration’s “Operation Warp Speed” was conducting various aspects of the development process concurrently rather than sequentially, eliminating delays unrelated to safety. However, those factors do not fully account for the condensing of clinical trial phases — each of which can take anywhere from 1–3 years on their own — to just three months apiece.

People of goodwill can disagree about the safety, efficacy and religious implications of a new vaccine for the coronavirus.

But, everyone should agree on this point:

No government can force anyone who has reached legal adulthood to be vaccinated for the coronavirus. Equally, no government can vaccinate minors for the coronavirus against the will of their parents or guardians.

Fear of a disease – which we know very little about, relative to other similar diseases – must not lead to knee-jerk reactions regarding public health, nor can it justify supporting the hidden agenda of governmental as well as non-governmental bodies that have apparent conflicts of interest in plans to restrict personal freedoms. 

The so-called “public health experts” have gotten it wrong many times during the current crisis. We should not, therefore, allow their opinions to rush decision-makers into policies regarding vaccination.

And, while some people, like Bill Gates, may have a lot of money, his opinion and that of his NGO (the Bill & Melinda Gates Foundation) – namely, that life will not return to normal till people are widely vaccinated – should not be permitted to influence policy decisions on a coronavirus vaccination program.

Finally, we must also not allow the rush by pharmaceutical companies to produce a new coronavirus vaccine to, itself, become an imperative for vaccination.

Unwitting citizens must not be used as guinea pigs for New World Order ideologues, or Big Pharma, in pursuit of a vaccine (and, profits) which may not even protect against future mutated strains of the coronavirus.

And it goes without saying that the production of vaccines using aborted babies for cell replication is a total non-starter, as the technique is gravely immoral.

However, if after sufficient study of the issue, a person who has reached the age of majority wishes to be vaccinated with a morally produced vaccine, along with his children, that is his business.

But we cannot and will not permit the government to make that decision for us.

While cases of severe harm reported to the federal Vaccine Adverse Events Reporting System (VAERS) after taking COVID vaccines represent less than one percent of total doses administered in the United States, a 2010 report submitted to the U.S. Department of Health & Human Services’ (HHS) Agency for Healthcare Research and Quality (AHRQ) warned that VAERS caught “fewer than 1% of vaccine adverse events.”

This past May, NBC News published a report acknowledging experts’ concerns about “gaps” in federal monitoring of the COVID vaccines. Judicial Watch, Daily Caller News Foundation Take University Of Delaware To Court Over Biden’s Senate Records

Attorneys representing the Daily Caller News Foundation and Judicial Watch took to court Wednesday arguing for access to records and communications about a treasure trove of documents related to President Joe Biden’s time as Senator housed at the University of Delaware.

The organizations were appealing a January decision by the Superior Court of Delaware which denied them access under the Delaware Freedom Of Information Act (FOIA) to the gift agreement between the university and Biden when he donated his Senate records as well as communications between the university and Biden and his representatives about the release of his Senate records.

The university said it will only make the documents public two years after Biden retires from public life. Oral arguments Wednesday centered on whether documents stored in publicly-funded institutions like universities could be accessed through a FOIA request.

“How the University of Delaware is storing, maintaining, processing, and releasing President Biden’s Senate records is of concern to the citizens of Delaware and all Americans,” President of Judicial Watch Tom Fitton said in a statement to the DCNF. “During today’s hearing, it seemed as though the Delaware Supreme Court is skeptical of the unusual secrecy in the handling of these records by the University.”

“Shelf space has value, utilities have value, real estate has value,” Green said Wednesday, pointing to the 4,000 cubic feet necessary to house more than 30 years worth of documents.

Green argued that the only evidence the University of Delaware submitted proving no public funds were used to house the documents are unsworn statements by university officials rather than affidavits, which he argued are insufficient. He also argued the Delaware Superior Court’s ruling unfairly shifted the burden of proof to the plaintiffs, maintaining that the university, as the custodian of the public documents, had to show that public funds were not used to house Biden’s records.

“The University of Delaware’s argument that a public university housing public records is not subject to public disclosure requirements would be comical if all this weren’t so serious,” Daily Caller News Foundation President Neil Patel said in a statement. “We are hopeful that the court will not allow this attempt to hide President Biden’s rightfully public information to stand.”

Bill Manning, the attorney representing the University of Delaware, argued Wednesday that whether or not state funds were used to house the documents is irrelevant. He maintained that if all documents housed at state expense were accessible under FOIA, that would mean that any and all documents housed in publicly-funded universities could be accessed by the public.

The records may contain information related to Tara Reade, a woman who accused Biden of sexually assaulting her in 1993. Reade said that information related to the incident could be stored at the university.

The DCNF and Judicial Watch had each filed FOIA requests for the records in April 2020, arguing that the records should be publicly available as their housing was paid for with public funds. The university denied the request, stating that “[t]here have been no expenditures of public funds regarding or related to the Joseph R. Biden, Jr. Senatorial papers.”

Both the DCNF and Judicial Watch filed petitions in Delaware’s Office of the Attorney General to determine whether the university’s decision violated FOIA, but the attorney general denied both petitions, siding with the university’s position that the records were not related to the expenditure of state funds.

The organizations then filed a joint appeal of the attorney general’s decision, arguing that the housing of Biden’s Senate records at the University of Delaware must have been paid for by public funds and pointing out that the university receives roughly $120 million in state funds each year. However, the ruling was upheld by the Superior Court of Delaware in January.

How Ben Shapiro’s Daily Wire Is Battling Back Against Biden’s Mandate

Imagine for a moment that Donald Trump were still president. Imagine that he went on television and said something like this: 

“The Department of Labor is developing an emergency rule to require all employers with 100 or more employees and together employ over 80 million workers to ensure that their workforces are fully vaccinated or show a negative test at least once a week.” 

That means, of course, that among other things, The New York Times, The Washington Post, ABC, CBS, NBC, CNN and MSNBC, all of whom employ far more than 100 employees, would be ordered by the Trump administration to comply. And if they failed to comply with the Trump order, they would have to pay a $14,000 fine per violation. 

And all those liberal media outlets would just quietly obey Trump, right?

Who’s kidding who? The instant Trump vanished from the television screen the editorialists, columnists and television commentators of all those liberal media outlets would be out front accusing Trump of an assault on a free press. The government, they would hotly insist, has zero right to tell any newspaper or television network what to do. The First Amendment would be instantly cited, reminding their audiences that it quite specifically says that “Congress shall make no law ….abridging the freedom of speech, or of the press.” One lawsuit after another would be filed against Trump’s mandate and that $14,000 fine by these liberal media outlets.

Suffice to say, the left-wing media firestorm has not happened because, doubtless, the president is named Biden, not Trump.

But over there at the conservative website The Daily Wire (created and run by Ben Shapiro), the rights of a free press are being taken seriously. Jeremy Boreing, the host of Daily Wire Backstage and the co-founder and co-CEO of The Daily Wire has sent out a note that says, in part, this: 

“Earlier this afternoon, Joe Biden announced that he is weaponizing the federal agency OSHA to force all companies with 100+ employees to either mandate vaccines or test their employees for COVID at least once per week.

Let me be clear: this is one of the most tyrannical overreaches of government power I have ever seen.  

This new ultimatum from the Biden administration will impact over 80 million workers in private sector businesses, including The Daily Wire. Companies that refuse to comply will face up to $14,000 in fines for each violation. They are trying to bully into submission any company that refuses to bend the knee to this tyranny.

Because the stakes are so high, I suspect most businesses will comply with Biden’s unconstitutional edict.

Not us. 

The Daily Wire will not comply with this tyrannical vaccine mandate.

Our legal team is already preparing for a potential lawsuit against the Biden administration.”

The note is also a pitch for money to help fund the lawsuit.

Boreing is 100 percent right. Whatever else this bit of Biden authoritarianism may be, it is a direct assault on a free press. The question is: Where exactly will all those aforementioned liberal media outlets come down? Will they be joining The Daily Wire in a fight to keep the Biden Administration from ordering newspapers and television networks to comply? Or will they simply stay silent and let the federal government tell them what they may or may not do?

Let’s be clear. If any private company wants to make being vaccinated or tested regularly a company rule, that’s completely different. As Biden did in fact note, media companies Fox News and Disney have done just that. But Fox News and Disney made their own decision. They do not and did not take orders from the President of the United States – and no media company ever should.

And ominously, Biden’s threats are not limited to the press.  He also made clear if various state governors – not coincidentally all Republicans – “will not help, if those governors won’t help us beat the pandemic, I’ll use my power as president to get them out of the way.”

Got that? Biden plans to get elected governors “out of the way.” Does it really need to be said that governors answer to their constituents – not Joe Biden?

This produced the following headline at Fox News: “Republicans explode with fury over Biden vaccine mandate: ‘Absolutely unconstitutional.'”

Republican Governor of South Carolina Henry McMaster was blunt and fiery in his Twitter reply

“The American Dream has turned into a nightmare under President Biden and the radical Democrats. They have declared war against capitalism, thumbed their noses at the Constitution, and empowered our enemies abroad.

Rest assured, we will fight them to the gates of hell to protect the liberty and livelihood of every South Carolinian.”

Texas Governor Greg Abbott tweeted

“Biden’s vaccine mandate is an assault on private businesses. I issued an Executive Order protecting Texans’ right to choose whether they get the COVID vaccine & added it to the special session agenda. Texas is already working to halt this power grab.”

Both are exactly right. And to the media point, media companies are exactly “private businesses.” As Governor McMaster says, Biden is indeed thumbing his nose at the Constitution, which most decidedly and specifically means Biden is thumbing his nose at the constitutional right of a free press.

Make no mistake. If Joe Biden is allowed to get away with telling any media outlet what to do, that will eventually be seen as precedent. 

A very dangerous precedent.

Ben Shapiro’s Daily Wire Announces It Won’t Comply with Biden’s Vaccine Mandate and Is ‘Prepared to Go to Battle’

As the story goes, on an April day in 1775 when John Parker of the Lexington militia gazed upon the might of England’s red-coated army arrayed against his tiny band of Massachusetts farmers, he told his men, “if they mean to have a war, let it begin here.”

The same defiant spirit in the face of a massive adversary flowed from Jeremy Boreing, co-founder and co-CEO of the Daily Wire, as he stared down the barrel of President Joe Biden’s vaccine mandate.

The Daily Wire, founded by Boreing and conservative commentator Ben Shapiro, employed 115 people as of January, according to an Axios report. That means Biden’s mandate, which will be enforced by the Department of Labor through its Occupational Safety and Health Administration, applies to the company.

Even so, Boreing said the edict will be ignored by the company.

“The Daily Wire does have more than 100 employees, but we won’t be enforcing Joe Biden’s unconstitutional and tyrannical vaccine mandate. That’s it. We’ll use every tool at our disposal, including legal action, to resist,” he said in a video posted to Twitter.

“Biden’s ultimatum will impact over 80 million private-sector workers. Companies that refuse to comply will face up to $14,000 in fines for every single violation. So, I’m sure most companies will probably just do it. They don’t have much choice. We won’t.”

Boreing explained there is a difference between supporting the vaccine and allowing big government to run roughshod over liberty.

“It’s not that we’re anti-vaccine. I’m personally very pro-vaccine. I think the COVID vaccines are probably the greatest scientific achievement so far in the 21st century. And I think the speed at which they were created may be Trump’s greatest achievement as president. They seem to do a pretty good job preventing hospitalization and a great job preventing death from COVID-19. That’s terrific,” he said.

Is this vaccine mandate wrong?

“If I were dictator, I’d probably make you get it. But I’m not a dictator. And neither is Joe Biden.”

Boreing said Biden’s mandate mingles bad policy with worse science.

“He has no right to impose this burden on American businesses. How are we supposed to pay for it? What are we going to do with all these new liabilities that we incur from injecting ourselves into the private health decisions of our employees? More to the point, he has no right to impose this burden on the American people,” Boreing said.

“It’s anti-science, and it’s totalitarian, and we cannot comply with it. I say anti-science because the mandate contains no exceptions for those in low-risk demographic groups. There’s no exceptions for those with natural immunity. Also, there’s no taking into account the fact that these vaccines are pretty effective. So if you’re vaccinated, congratulations, you’re at low risk from COVID-19 whether your neighbor is vaccinated or not. And that’s good news, since you’re vaccinated neighbor can still transmit the d*** disease.”

As he spoke, Boreing noted that tyrants still exist.

“And I say it’s tyrannical, because using unelected bureaucratic machinery like OSHA, to force small businesses into becoming the vaccine and testing enforcement arm of the federal government is definitionally anti-democratic. It marks a dramatic break with our constitutional order,” he said.

Boreing said Americans who have chosen not to be vaccinated “shouldn’t have to get it because it’s a free country.”

“So Joe Biden has no compelling reason to encroach on our liberties, other than he just doesn’t like what we do with them. Well, guess what? Joe Biden isn’t your mom. The government isn’t your mom. And your employer sure as hell isn’t your mom.”

Boreing said enough liberty has been lost in the expansion of government power that has accompanied the coronavirus.

“We’ve already watched for over a year and a half as Americans have ceded liberty after liberty to wannabe tyrants like Anthony Fauci. They broke our economy. They locked us in our homes. They destroyed our supply chains. They crushed our small businesses. They masked our children. Enough. That is enough,” he said.

Boreing then repeated his bottom line.

“So the answer’s no. No, The Daily Wire won’t be enforcing Joe Biden’s petty tyranny,” he said. “We’ve already retained legal counsel and we’re prepared to go to battle with this administration to put an end to their unconstitutional bulls***. We hope other people and other businesses will join us. If they do, great. If they don’t, that’s fine too.

“There’s got to be a line and for us, this is it. So Joe, hard pass.”

Out Of Our Daily Lives

Zoom, the software many had never heard of prior to COVID-19 and the lockdowns that followed, surged nearly 400 percent last year. But as many industries return to being in person — and competition flourishes due to other businesses offering services accompanied by other features — it took a more than 15 percent tumble on Tuesday. This is a good thing.

Amid societal decay and economic turmoil, Chinese-American billionaire Eric Yuan’s company made a killing. Although shares fell, the stock recorded an astounding $1 billion in quarterly revenue for the first time in its history, beating analyst estimates. But as Maria Armental of the Wall Street Journal noted, its revenue increase was nothing compared to before.

“While the company forecast revenue of more than $1 billion again in the current quarter, its adjusted earnings guidance came in lower than expected,” Armental wrote. “And company officials said small businesses and consumers were starting to spend less as opportunities for in-person meetings and gatherings expand.”

Zoom’s present and conceivable future struggles, at least compared to its gigantic, seemingly overnight success, makes complete sense in conjunction with the current conditions of the United States. Americans are dissatisfied with lockdowns.

Schools, which encompassed a significant portion of Zoom’s growth, are largely taking place in person this year. The coronavirus has led companies to reconsider remote work, as The Federalist’s Joy Pullmann described in a recent article, but certainly many industries are ditching the screen as a be-all, end-all for corporate life. This includes banks such as Morgan Stanley, JPMorgan Chase, Goldman Sachs, and Bank of America.

“If you can go to a restaurant in New York City, you can come to the office,” Morgan Stanley CEO James Gorman said at a June investing conference. “And we want you in the office.” Executives at JPMorgan shared a similar sentiment earlier in the summer, stating, “We firmly believe that working together in person is important to our culture, clients, businesses and teams.”

Zoom was never meant to replace the workplace. Yuan admitted as much back in May. Speaking at a virtual summit with CEOs, the Zoom czar described how he never schedules any “back-to-back meetings anymore” due to his “Zoom fatigue.”

Of course, the trivial “Zoom fatigue” of a man with a $14.3 billion net worth should not be the concern of anyone. There are men working in dusty coal mines breaking their backs. There are police officers and firefighters dealing with arrogant lawmakers and activists who do not respect their work, as they put their lives on the line amid spiking crime. There are auto mechanics fixing cars during a global supply and trade shortage.

Please, one would be justified in saying, spare us the woes of the laptop class. But two things can be true at once.

While it proved serviceable in linking people at the beginning of government-enforced lockdowns, Zoom is not real life. Some workplaces may wish to remain in a perpetual state of digital adoration — particularly the Too Online members of society — but disavowing bureaucrats who want to shutter society until every inch of COVID is erased should be top of mind for Americans.

Lockdowns have taken an unforgettable toll on every aspect of American society: depression, suicide, obesity, economic despair, and the impediment to constitutional rights. As The Federalist’s Tristan Justice articulated this week, “A year of at-home [of] Zoom instruction … has now brought devastating consequences beyond cognitive decline.”

“The re-emergence of these failed measures threaten to wreak havoc on the nation’s psyche,” Justice also wrote. “It was once headed back to a normal that now may never return as Americans begin to cope with the lives they lose under lockdown.”

Such cognitive decline has the ability to spread when the world is reliant on a video conferencing platform to function. In the case of vulnerable school children especially, studies reliably show that social isolation is a pandemic itself necessary to combat. Living in “the pod,” as New York Post Op-Ed Editor Sohrab Ahmari articulated at a recent Intercollegiate Studies Institute conference I attended, is indicative of undeniable “dystopia.”

The pod we have allowed to envelop us is unsustainable. It is unsustainable because it is contrary to human nature. It should come as no surprise, but it feels vital to reiterate: chat buttons do not substitute messages, emojis do not substitute emotions, and video chats do not substitute in-person interactions that foster nuance.

It is no doubt counterintuitive to argue Americans should want a stock to tank. One need only turn back the clock to our 2008 housing bubble to understand just how significant the market is in terms of economic well-being, even though Zoom is only one piece of an expansive pie.

Zoom is a company that boomed on COVID, however. It has artificially been elevated as our norm, but it is no such thing. Unlike a company like Microsoft that offers much more than just video-chatting, Zoom was made for a time such as this. But this time needs to pass.
